1. Acceptance
These Terms and Conditions ("Terms") govern your access to and use of BarReps and the website at barreps.com (the "Service"), operated by BarReps LLC ("BarReps," "we," "us," or "our"). By creating an account, checking a box indicating that you agree to these Terms, accessing limited content, or starting a free trial or paid subscription, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
BarReps provides bar exam study materials and practice tools, including practice questions, flashcards, subject outlines, and MEE-style practice essays. The Service is a study supplement. It is not a substitute for professional instruction, and it does not guarantee any particular result.
3. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. One account is for one person. Sharing an account or your login credentials with others is not permitted.
4. Subscriptions, Free Trial, Billing, and Automatic Renewal
BarReps offers a monthly plan at $69.99 per month and a three month plan at $189.99.
Monthly plan: The monthly plan includes a 7 day free trial. If you do not cancel before the trial ends, your paid monthly subscription begins automatically and the payment method on file is charged $69.99. The monthly subscription then renews automatically each month at $69.99 until you cancel.
Three month plan: The three month plan is a single payment of $189.99 for three months of access. It does not renew automatically. Access ends at the conclusion of the three month period unless you purchase again.
By starting a subscription, you authorize us and our payment processor to charge your payment method on the schedule described above. You may cancel at any time through your account settings or by contacting support@barreps.com. Cancellation takes effect at the end of the current billing period, and you retain access until then. We do not provide prorated refunds for partial billing periods except as described in Section 5.
5. Refunds
If BarReps is not useful to you within your first 7 days, email support@barreps.com and we will refund your payment. No questions, no forms, no hoops. Because the monthly plan includes a free trial, you can cancel the monthly plan before any charge is made.
6. No Guarantee of Results; No Affiliation
We do not guarantee that using BarReps will result in a passing score on any bar examination or any other particular outcome. Your results depend on many factors outside our control, including your own preparation and background and the policies of the jurisdiction where you sit for the exam. BarReps is independent. It is not affiliated with, endorsed by, or sponsored by the National Conference of Bar Examiners or any state board of bar examiners. Practice content is described as MEE-style and is not drawn from any actual administered examination.
7. Educational Content; Not Legal Advice
All content on BarReps, including practice questions, flashcards, outlines, and essays, is provided solely for bar exam preparation. It is not legal advice and does not create an attorney-client relationship. Legal rules vary by jurisdiction and change over time, and content may not reflect the current law of any jurisdiction. Some practice content intentionally presents outdated or incorrect statements of law as answer choices for instructional purposes. Do not rely on any BarReps content as a statement of current law or as a substitute for independent legal research.
8. Intellectual Property and License
All content and materials available through the Service, including questions, answer explanations, flashcards, outlines, essays, text, design, and software, are owned by BarReps LLC or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own bar exam preparation. You may not copy, reproduce, distribute, publish, sell, sublicense, scrape, data-mine, or create derivative works from any part of the Service, and you may not share your access with others.
9. Acceptable Use
You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with its operation, using automated means to extract content, or using the Service in violation of any law.
10. Privacy and Data
We collect and process account, usage, and payment related information in order to provide the Service. Payments are processed by our payment processor, and we do not store full payment card numbers. We use third party providers for hosting, analytics, and email delivery. We use these only to operate and improve the Service.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.
12. Limitation of Liability
To the fullest extent permitted by law, BarReps LLC and its members, officers, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss arising from your use of or inability to use the Service, including any reliance on its content. Our total liability for any claim relating to the Service will not exceed the amount you paid to us in the twelve months before the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless BarReps LLC and its members, officers, and agents from any claims, damages, liabilities, and expenses, including reasonable attorney fees, arising from your misuse of the Service or your violation of these Terms or any law.
14. Dispute Resolution; Arbitration; Class Action Waiver
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. The arbitration will take place in Ohio or be conducted remotely, at the consumer's option. You and BarReps waive any right to a jury trial and agree that claims will be brought only in an individual capacity and not as part of any class or representative action.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws rules. Subject to Section 14, any action relating to these Terms will be brought in the state or federal courts located in Ohio, and you consent to their jurisdiction.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide notice through the Service. Your continued use after changes take effect constitutes acceptance.
